Litigation SupportTreestand - PTO PinClient Industry: Civil LitigationResult: Settlement RWFE was hired to determine the cause of failure after a treestand disengaged from a tree and fell to the ground. The treestand design utilized several locking pins that kept it fastened to the tree. Each pin was designed to lock into place by snapping into an angled slot. Inspection showed that two of the three subject PTO pins did not fully engage in the slot, but one of the pins locked securely in place. Several packages of exemplar PTO pins by the same manufacturer were purchased and more pins were found to have the same problem. Without fully seating in the bottom of the slot the pins did not remain securely in place. Based on this information and other information obtained through discovery our client was able to secure a settlement based on a theory of manufacturing defect. Sometime after the case a re-design of the PTO pin was released that included a winged nut which screwed in to place to prevent the pin from accidentally coming unlatched. |
