Time and Distance Required to Stop a Commercial Vehicle

Result: Settlement in favor of Defendant on counterclaim

We were retained by Defense Counsel to render an expert opinion on conditions leading to the collision between a commercial vehicle and Defendant’s automobile. Initially, Plaintiff brought suit against Defendant for failure to yield right of way to Plaintiff’s vehicle. After a review of case material and the accident scene, we performed calculations to determine whether the commercial vehicle should have been able to decelerate enough to avoid collision with Plaintiff’s vehicle altogether, or to decrease the extent of damage to Plaintiff’s vehicle and its occupants. The analysis revealed that the truck driver had sufficient time to perceive the impending danger and react by engaging his brakes during the time interval prior to impact. There was enough time to for Plaintiff to have stopped the vehicle altogether prior to impact. Had Plaintiff been unable to avoid the collision, even slight braking would have decreased the energy delivered to Defendant’s vehicle by up to 84%.

Based on this information, Defense Counsel filed a counterclaim alleging failure to keep a proper and prudent lookout and faulty evasive maneuvers.
